盲人12306购票遇阻欲起诉\/Blind Users Lawsuit Against Rail Website Rejected

Chen Wen (pseudonym) was born in Gansu province and lost his sight at the age of 10. For the last six years, Chen has lived in Beijing, where he works as a massage therapist.
陈文（化名）出生在甘肃庆阳，因患有先天性视神经萎缩，到10岁时完全双目失明。2010年，陈文从老家来到北京，在一家按摩店做按摩师。
But an update to 12306, the official website of China’s national railway system, left Chen and millions of other blind users unable to book tickets during the holiday.
在12306更新图形验证码后，买火车票成为了陈文最大的难题，因为他看不到网站上的图形验证码，因此也买不了火车票。
To complete a booking, the user must enter a verification code designed to defeat the screen reading software on which blind users depend. Unlike many websites designed to offer equal access, 12306 does not offer an audio alternative to the code.
Chen said that before 2015, the verification code consisted of numbers and characters and included an audio version of the code for users with limited vision.
2015年之前，12306官网验证码是以输入数字和英文为主，这个还比较好解决。”陈文说，视障人士使用的手机和电脑上，一般都装有带有朗读功能的读屏软件，“但软件不能读图。”
However, in 2016 the company changed its verification code system to something graphical. Chen said blind users only have two ways to solve the problem: to send a picture to their sighted friends, or to make a video call to a sighted friend and ask for help.
Both infringe on the independence of China’s blind travelers.
陈文说，一般他们有两种解决方法。“要么截图，再发给有视力的朋友帮忙看一下，要么就打开摄像头，让他们看着指导我们操作。”归根结底，这两种方式都需要有明眼人在一旁提供帮助。“其实很麻烦，自己一个人没法完成。”
Chen and several friends with visual impairments decided to sue China Railway, China Railway Information Center and the China Academy of Railway Science. Chen asked for 110 yuan to compensate him for taxi fees and 1 yuan for pain and suffering, as well as an apology from the three defendants.
More importantly, Chen also asked them to fix the website.
后来，陈文聘请了律师，和几名视觉障碍的朋友一起决定起诉12306网站的所有方和设计方：中国铁路总公司、中国铁路信息技术中心和中国铁道科学研究院。陈文起诉要求三被告向其书面道歉，承诺对12306网站进行信息无障碍改造，杜绝歧视；赔偿打车费110元和精神损失费1元；承担本案诉讼费。
At the pretrial, China Railway said the company is developing new ways to stop scalpers from buying and selling train tickets. China Railway Information Center and China Academy of Railway Science said their platform did not infringe on Chen’s rights, and that railway tickets can also be purchased at the train station.
中铁信息中心、中铁科研院答辩称，他们没有实施任何侵犯陈文权利的行为，网站购票只是现有众多购买火车票的途径之一，并非唯一，现存各种购票途径可以购买的火车票范围种类内容无差异。陈文可以在他人协助下完成网络购票，或者通过其他方式购票。
The court decided not to hear Chen’s case.
